- Membership fee Rs. 500/- is non refundable
- Any Individual or family or firm or company or association can apply for purchasing the plots abiding by the salient features and terms conditions herein contained. Minor or mentally unsound persons are not entitled to be members. Employees and agents of the company cannot be the applicant.
- An applicant paying one time (outright) initially shall avail 5% discount at the time of booking.The Company will give registration to the outright scheme members within 6 months of the plot booking.
- The Registration of plot will be made after full payment.
- An applicant can subscribe for any number of plots.But allotment of plot/plots is within sole discretion of the management of the company.
- The registration charge including stamp duty and allied expenses will be borne by the purchaser.
- The one time payment and subsequent monthly installments payment by the applicant for the plots shall be paid through A/c payee Bank Draft/Cheque/Pay Order drawn in favour of bisal Estcon Limited, payable at BBSR on or before 10th day of every calendar month.
- Front lane plots shall charged 5% extra of the total cost.
- Corner plot shall cost 10% extra of the total cost.
- Members shall not be entitled to raise loan or create security or any nature of encumbrance over his subscription amount already paid or on the plot to be alloted till execution and registration of sale deed of the plot in his name.
- Members committing defult in payment of any installment are strictly barred from raising any dispute in any forum for a plot or claiming refund of the subscribed amount.
- A member can transfer of his plot in his own responsibility to any person during the scheme period on payment of Rs.1000/-(Rupees one thousand only) to the company towards transfer processing charges.
- The entire control and management of the plots scheme shall be exclusively of the company subject to the stipulations supra.
- Defaulter (Payment terms) shall have no claim over the choice of the plot.
- Members who don't pay their monthly instalments continouously for three months will be cancelled from scheme as per the company rules.
- Rules, regulation, Laws, notifications orders, instructions, Taxes, fees, charges, levies, caluations, sanctions, approval of layouts plotting, acquisition of the Govt. local authorities, Development authorities revenue authorities wilol govern the plots and gifts of this scheme.
- The company shall not be responsible for the Govt. acquisition of land of this plots scheme or for the acts of God, earth quake, cyclone, valcano eruption, floods causing damage and loss to the plots.
- If the company is prevented or delayed by any reason or cause of change laws, rules, regulations and of the orders of the Govt. local bodies,Judicial courts. Statutory authorities from alloting or selling or devering any plots permanently to the members. the company shall allot plots to the members alternatively in different area.
- The members shall at their cost and responsibility get the change of charcter, classification and nature of land and the mutation of the plot sold and delivered to them.
- Payment of subscription amount in cash by the membersto the authorised Field Officer/Agents of the Company is strictly not allowed.For deviation of it the company shall not be responsible for such payment in any manner. Payment should be made only by A/C payee Bank Draft in favour of Bisal Estcon Limited payable at Bhubaneswar.
- The company shall not responsible for any over selling or false commitment not covered by this indenture, by the field staff or any other person to the members.
- if any revenue conversion charges are implemented by the Govt. it will be brone by the member.
- If the area is excess or less than the unit area, the difference in cost will be borneby the member or the company respectively.
- All postal communication will be sent at the address mentioned in the application form. Member should keep informed the company if any changes in postal address.
- In case of cancellation 15% of the deposited amount will be deducted towards the processing charges. The refund amount will be paid by the company through A/c Payee Cheque after 60 days from the date of refund application.
- All kind of TDS in Income Tax will be borne by the Member.
- The disputes in any by the non-defaulter members concerning this plots scheme, shall be subjected to arbitration only through a retired judge of company's preference only at Bhubaneswar, Orissa.
- All legal matters comes under Bhubaneswar jurisdiction.
- The Company reserves the right of accepting or rejecting any application received.
